Colin P. O’Rourke is a partner of our firm with a practice focusing primarily on toxic tort, mass tort, oilfield legacy and environmental litigation, as well as workers’ compensation, subrogation, and third-party recovery, including recovery from the Louisiana Second Injury Fund.

Litigation Experience:

  • Defense of oil and gas operators in environmental contamination litigation involving historical operations, including dismissal of landowner mineral lease claims on summary judgment, see e.g., Litel Explorations, L.L.C. v. Aegis Development Company, L.L.C., et al. 2020-373 (La. App. 3 Cir. 11/12/20), 307 So.3d 1087
  • Defense of chemical manufacturer against environmental contamination claims brought by neighboring landowners related to pipelines transporting solution-mined brine, Boudreaux v. Axiall Corp., et al., 595 F.Supp.3d 517 (W.D. La. 2022)
  • Defense of chemical manufacturers in class actions and mass joinders relating to offsite releases from facilities
  • Defense of chemical manufacturer against trespass claims by neighboring landowner related to subsurface solution-mined brine caverns
  • Defense of chemical manufacturers in premises liability litigation related to alleged exposure to asbestos, benzene, and silica dust
  • Defense of chemical manufacturer in complex toxic exposure litigation involving expert testimony in the fields of chemical engineering, air-modeling, and toxicology
  • Defense of industrial equipment manufacturer in products liability litigation involving a fatality at a steel pipe production facility
  • Defense of employers against claims of wrongful termination and retaliatory discharge brought by former employees
  • Extensive experience pursuing claims for reimbursement against third party tortfeasors and the State of Louisiana's Second Injury Fund on behalf of employers, self-insured entities, and insurers.
  • Defense of workers’ compensation insurers in billing disputes concerning the application of Louisiana Workers’ Compensation Fee Schedule
